THE POWER OF GOVERNOR
A governor is the constitutional head of a state is appointed by the president of India. In the name of a Governor, all the executive action of a state is taken. But actually, it was taken by CM & the council minister.
According to articles 153 & 154, a governor can serve as Governor of more than one state at the same time. For example, now UP Governor Anadiben Patel also serves as the Governor of MP as Lalji Tandan (Governor of MP) was died.
Like that Governor in states, Lieutenant governor & administrator (An IAS officer) are appointed in Union territory. They have similar power as Governor. The Governor of Punjab also acts as the lieutenant governor of Chandigarh. Dadra Nagar Haveli & Daman Diu, Lakshadweep have administrators where other UTs have Lt. Governor.
A governor uses Raj Bhavan(Official residence) without paying any payment.
The salary of the Governor is 1.1 lakh per month.
They hold the Office during the pleasure of the president for a period of a maximum of 5 years.
They may be designed by writing his hand addressed to the president.
QUALIFICATION OF GOVERNOR
- According to article 158, A Governor
- must be a citizen of India
- Shall not be a member of parliament or House of Legislative Assembly or Council
- Has Completed the age of 35 years
The oath of Governor is administered by the chief justice of the concerned state High court.
I …….(name), do swear in the name of God that I will faithfully execute the office of Governor of …. (name of concerned state) & will to best of my ability defend and protect the constitution and the law and that I will devote myself to the service And well- being of the people of ……( name of concerned state)
He appoints the state election commissioners, Chairman and members of the state public service commission, VCs of universities etc.
All Executive action of the government of a state is taken in his name.
He can take any information relating to the administration of the affairs of the state and proposals for legislation from the CM.
The state budget is laid before the state legislature by him.
-Governor is an integral part of the state legislature.
-He has the right of addressing and sending messages to the state Assembly.
-He appoints 1/6th member of the legislative council.
-He has the power to nominate one Anglo Indian to the legislative assembly.
The Governor has no emergency powers to counters external aggression, he reports to the president if the state government is not running properly.
